The services that Ease Electrical Group provides to Users is subject to the following Terms of Use . Ease Electrical Group reserves the right to update the Terms Of Use at any time without notice to User. Our Terms Of Use can be reviewed by clicking on the “Terms of Use” hypertext link located at the bottom of our Web pages.

  •        This Agreement, which incorporates by reference other provisions applicable to use of the ‘Ease Electrical Group Website’, including, but not limited to, supplemental terms and conditions set forth hereof (“Supplemental Terms”) governing the use of certain specific material contained on ‘Ease Electrical Group Website’, sets forth the terms and conditions that apply to use of ‘Ease Electrical Group Website’ by User. By using Ease Electrical Group (other than to read this Agreement for the first time), User agrees to comply with all of the terms and conditions hereof. The right to use ‘Ease Electrical Group Website’ is personal to User and is not transferable to any other person or entity. User is responsible for all use of User’s Account (under any screen name or password) and for ensuring that all use of User’s Account complies fully with the provisions of this Agreement. User shall be responsible for protecting the confidentiality of User’s password(s), if any.
  •        Ease Electrical Group shall have the right at any time to change or discontinue any aspect or feature of ‘Ease Electrical Group Website’, including, but not limited to, content, hours of availability, and equipment needed for access or use.
  •        CHANGED TERMS

Ease Electrical Group shall have the right at any time to change or modify the terms and conditions applicable to User’s use of ‘Ease Electrical Group Website’, or any part thereof, or to impose new conditions, including, but not limited to, adding fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on ‘Ease Electrical Group Website’, or by electronic or conventional mail, or by any other means by which User obtains notice thereof. Any use of ‘Ease Electrical Group Website’ by User after such notice shall be deemed to constitute acceptance by User of such changes, modifications or additions.

  •        EQUIPMENT

User shall be responsible for obtaining and maintaining all telephone, computer hardware, software and other equipment needed for access to and use of ‘Ease Electrical Group Website’ and all charges related thereto.

  •        USER CONDUCT
  •        User shall use the ‘Ease Electrical Group Website’ for lawful purposes only. User shall not post or transmit through the ‘Ease Electrical Group Website’ any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without Ease Electrical Group ‘s express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a User that in Ease Electrical Group’s discretion restricts or inhibits any other User from using or enjoying the ‘Ease Electrical Group Website’ will not be permitted. User shall not use the ‘Ease Electrical Group Website’ to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of users to become subscribers of other on-line information services competitive with Ease Electrical Group.
  •        ‘Ease Electrical Group Website’ contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound, and the entire contents of ‘Ease Electrical Group Website’ are copyrighted as a collective work under the Australian copyright laws. Ease Electrical Group owns a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. User may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. User may download copyrighted material for User’s personal use only. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of Ease Electrical Group and the copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. User acknowledges that it does not acquire any ownership rights by downloading copyrighted material.
  •        User shall not upload, post or otherwise make available on the ‘Ease Electrical Group Website’ any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with User. User shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting material to any public area of the ‘Ease Electrical Group Website’, User automatically grants, or warrants that the owner of such material has expressly granted Ease Electrical Group the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. User also permits any other User to access, view, store or reproduce the material for that User’s personal use. User hereby grants Ease Electrical Group the right to edit, copy, publish and distribute any material made available on the ‘Ease Electrical Group Website’ by User.

 

  •        USE OF SERVICES

The Services may contain e-mail services, bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, photo albums, file cabinets and/or other message or communication facilities designed to enable User to communicate with others (each a “Communication Service” and collectively “Communication Services”). User agrees to use the Communication Services only to post, send and receive messages and material that are proper and, when applicable, related to the particular Communication Service. By way of example, and not as a limitation, User agrees that when using the Communication Services, User will not:

  •        Use the Communication Services in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise).
  •        Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
  •        Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, obscene, indecent or unlawful topic, name, material or information.
  •        Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless User own or control the rights thereto or have received all necessary consent to do the same.
  •        Use any material or information, including images or photographs, which are made available through the Services in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party.
  •        Upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another’s computer or property of another.
  •        Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Services specifically allows such messages.
  •        Download any file posted by another user of a Communication Service that User know, or reasonably should know, cannot be legally reproduced, displayed, performed, and/or distributed in such manner.
  •        Falsify or delete any copyright management information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
  •        Restrict or inhibit any other user from using and enjoying the Communication Services.
  •        Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service. Harvest or otherwise collect information about others, including email addresses. Violate any applicable laws or regulations.
  •        Create a false identity for the purpose of misleading others. Use, download or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of users of the Services or other user or usage information or any portion thereof.
  •        Ease Electrical Group has no obligation to monitor the Communication Services. However, Ease Electrical Group reserves the right to review materials posted to the Communication Services and to remove any materials in its sole discretion.
  •        Ease Electrical Group reserves the right to terminate User’s access to any or all of the Communication Services at any time, without notice, for any reason whatsoever. Ease Electrical Group reserves the right at all times to disclose any information as it deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Ease Electrical Group’s sole discretion.
  •        Materials uploaded to the Communication Services may be subject to posted limitations on usage, reproduction and/or dissemination; User is responsible for adhering to such limitations if User downloads the materials. Always use caution when giving out any personally identifiable information in any Communication Services.
  •        Ease Electrical Group does not control or endorse the content, messages or information found in any Communication Services and, therefore, Ease Electrical Group specifically disclaims any liability with regard to the Communication Services and any actions resulting from User’s participation in any Communication Services. Managers and hosts are not authorized Ease Electrical Group spokespersons, and their views do not necessarily reflect those of Ease Electrical Group.

 

  •        MATERIALS PROVIDED TO EASE ELECTRICAL GROUP OR POSTED AT ANY OF ITS WEB SITES

Ease Electrical Group does not claim ownership of the materials User’s provide to Ease Electrical Group (including feedback and suggestions) or post, upload, input or submit to any Services or its associated services for review by the general public, or by the members of any public or private community, (each a “Submission” and collectively “Submissions”). However, by posting, uploading, inputting, providing or submitting (“Posting”) User’s Submission User is granting Ease Electrical Group, its affiliated companies and necessary sub-licensees permission to use User’s Submission in connection with the operation of their Internet businesses (including, without limitation, all Ease Electrical Group Services), including, without limitation, the license rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat User’s Submission; to publish User’s name in connection with User’s Submission; and the right to sub license such rights to any supplier of the Services.

No compensation will be paid with respect to the use of User’s Submission, as provided herein. Ease Electrical Group is under no obligation to post or use any Submission User may provide and Ease Electrical Group may remove any Submission at any time in its sole discretion. By Posting a Submission User warrants and represents to own or otherwise control all of the rights to User’s Submission as described in these Terms of Use including, without limitation, all the rights necessary for User to provide, post, upload, input or submit the Submissions. In addition to the warranty and representation set forth above, by Posting a Submission that contain images, photographs, pictures or that are otherwise graphical in whole or in part (“Images”), User warrant and represent that

  •        User is the copyright owner of such Images, or that the copyright owner of such Images has granted User permission to use such Images or any content and/or images contained in such Images consistent with the manner and purpose of User’s use and as otherwise permitted by these Terms of Use and the Services,
  •        User have the rights necessary to grant the licenses and sub-licenses described in these Terms of Use, and
  •        that each person depicted in such Images, if any, has provided consent to the use of the Images as set forth in these Terms of Use, including, by way of example, and not as a limitation, the distribution, public display and reproduction of such Images.
  •        By Posting Images, User is granting (a) to all members of User’s private community (for each such Images available to members of such private community), and/or (b) to the general public (for each such Images available anywhere on the Services, other than a private community), permission to use User’s Images in connection with the use, as permitted by these Terms of Use, of any of the Services, (including, by way of example, and not as a limitation, making prints and gift items which include such Images), and including, without limitation, a non-exclusive, world-wide, royalty-free license to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat User’s Images without having User’s name attached to such Images, and the right to sub-license such rights to any supplier of the Services. The licenses granted in the preceding sentences for a Images will terminate at the time User completely remove such Images from the Services, provided that, such termination shall not affect any licenses granted in connection with such Images prior to the time User completely remove such Images. No compensation will be paid with respect to the use of User’s Images.

 MONITORING

Ease Electrical Group shall have the right, but not the obligation, to monitor the content of ‘Ease Electrical Group Website’, including chat rooms and forums, to determine compliance with this Agreement and any operating rules established by Ease Electrical Group and to satisfy any law, regulation or authorized government request. Ease Electrical Group shall have the right in its sole discretion to edit, refuse to post or remove any material submitted to or posted on ‘Ease Electrical Group Website’. Without limiting the foregoing, Ease Electrical Group shall have the right to remove any material that Ease Electrical Group, in its sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable.

 

  •        MISCELLANEOUS

This Agreement and any operating rules for ‘Ease Electrical Group Website’ established by Ease Electrical Group constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. This Agreement shall be construed in accordance with the laws of the [STATE, COUNTRY], without regard to its conflict of laws rules. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import.

  •        COPYRIGHT NOTICE

Ease Electrical Group and it’s logos are trademarks of Ease Electrical Group Ltd. All rights reserved. All other trademarks appearing on Ease Electrical Group are the property of their respective owners.

  •        TRADEMARKS

The names of actual companies and products mentioned herein may be the trademarks of their respective owners. The example companies, organisations, products, domain names, email addresses, logos, people and events depicted herein are fictitious. No association with any real company, organisation, product, domain name, e-mail address, logo, person, or event is intended or should be inferred. Any rights not expressly granted herein are reserved.

Trade T&CS

  1. Applicability & Interpretation

These terms and conditions apply to any and all agreements for the provisions of Goods and Services by the Seller and supersede any contrary terms and conditions of the Customer.

The Seller may amend these Terms and Conditions, its policies or any notices from time to time at its discretion. The Customer will be bound by any amended, revised and or updated Terms and Conditions notified to the Customer from time to time. Where more than one Customer has entered into this Contract, each Customer shall be jointly and severally liable for all payments of the Price.

  1. Definitions

“Australian Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010 (Commonwealth) and any other consumer protection legislation in force in Australia;

“Contract” means this contract for the sale of Goods or Services by the Seller to the Customer and includes any plans and drawings prepared for the proposed Services.

“Customer” shall mean the person who places an Order for the Goods or Services from the Seller and includes any person acting on behalf of and with the authority of the Customer.

“Goods” shall mean goods and products supplied by the Seller to the Customer and where the context so permits shall include the supply of any Services from the Seller to the Customer.

“GST” has the meaning given to it in the “GST Act” being a New Tax System (Goods and Services Tax) Act 1999 (Cth);

“Liability” means all liability whatsoever and howsoever arising including but not limited to any liability for damages and loss, liquidated damages, loss of profit, loss of revenue, loss of use, economic or indirect and consequential loss.

“Order” means any order for the purchase of Goods or the supply of Services placed by the Customer with the Seller.

“PPSA” means the Personal Properties Security Act 2009 (Cth).

“Price” shall mean the cost of the Goods as agreed between the Seller and the Customer subject to any adjustment or variation in accordance with the terms of this Contract.

“Quote” means the estimated Price given by the Seller to the Customer to supply the Goods or perform the Services.

“Seller” shall mean Ease Electrical Group Pty Ltd trading as ‘Ease Electrical Group’ and its successors and assigns.

“Services” shall mean all services supplied by the Seller to the Customer and includes any advice or recommendations and where the context so permits shall include any supply of Goods.

  1. Acceptance

The acceptance of the Quote and placement of an Order by the Customer constitutes unqualified and irrevocable, acceptance by the Purchaser to be bound by these Terms and conditions which may only be varied and or rescinded strictly in accordance with these Terms and Conditions.

No contractual obligation shall arise until the Seller has accepted an Order from the Customer.

Goods and Services in Excess of $20,000.00: If the Price for the Goods and Services exceeds the sum of $20,000.00 the Customer may rescind the Contract within five (5) business days of the date of placement of the Order (the Cooling Off Period). If the Customer within the Cooling Off Period exercises its right to rescind the Contract, the Customer acknowledges and agrees that the Seller shall be entitled to be paid from the deposit the following:

The cost of any Goods and Services already completed by the Seller including any materials and items purchased by the Seller forming part of the Goods and Services to be provided; and

The cost of any administration time, disbursements, permits and planning expenses incurred by the Seller prior to the date of rescission.

If the amount due and owing by the Customer to the Seller exceeds the amount of the deposit the Customer must pay the balance due to the Seller within seven (7) days of receiving written notice of the amount due to the Seller; is less than the deposit the Seller must refund to the Customer the surplus balance within seven (7) days of the Seller calculating the amount due and owing to it.

  1. Goods and Services

The Goods and Services are described in the Quote and Order as provided by the Seller to the Customer.

The Goods and Services supplied by the Seller shall, to the extent that it is the Seller’s obligation to do so, comply with: the Building Code of Australia, to the extent required under the Environmental Planning and Assessment Act 1979; all other relevant codes, standards and specifications that the work is required to comply with under any law; the conditions of any relevant development consent or complying development certificate.

The Seller will not be liable to the Customer for any liability, loss or damage for a failure to comply. The design or specification is prepared by or on behalf of the Customer including its consultants and expert advisors (but not the Seller); or the design or specification is requested by the Customer and the Seller has advised the Customer in writing that the design or specification does not comply with the requirements or do not comply with the Statutory Warranties set out in section 18B of the Home Building Act 1989.

  1. Price & Payment

The Price payable by the Customer for the Goods and Services shall be the Price set out in the Order if the Seller’s Quote is accepted within thirty (30) days of the date of the Quote. If the Seller’s Quote is not accepted within the thirty (30) day period or the Seller is delayed in commencing the date for provision of the Goods or Services due to delays not caused by the Seller the Price shall be the Seller’s then current price for the Goods and Services, at the date of delivery of Goods or performance of the Services, according to the Seller’s current Price list.

Payment of the Price shall be made by the Customer:

by cash, or by cheque, or by bank cheque, or by credit card, or by direct credit, or by any other method agreed prior by the Seller; at the time of placement of the Order or if no time is stated on the Order then on the earlier of delivery of the Goods or commencement of the Services; orwhere progress payments or instalments are agreed in the Order at the time each progress payment or instalment is due.

The Customer acknowledges that the Seller may cease works, stop the works or refuse to release the Goods where the Customer has not paid the Price, instalment or progress payment on the due date. Payment by the Customer will only be recognised by the Seller when the payment is received in clear funds into the Seller’s bank account or when cheques provided for payment have cleared.

Any variation from the plan of scheduled works, specifications or additional works that may have not been reasonably anticipated by the Seller for the provision of the Goods and Services will be charged as a variation (Variation). If a Variation is required:  the Seller will provide the Customer with a Quote for the Variation prior to commencing the Variation and the Customer must notify the Seller whether it accepts the Variation as soon as possible but no later than five (5) days after receiving the Variation request;

If the Customer does not accept the Variation within the five (5) day period the Seller is not obliged to perform the Variation. If the Customer accepts the Variation the Customer must pay for the costs of the Variation on the earlier of the next instalment date or on the date of completion of the works.

The Seller may terminate this Contract, without liability to the Customer, if the Customer does not authorise the Variation and the Seller cannot reasonably proceed with the Services without undertaking the works proposed under the Variation.

The Customer acknowledges that the Seller may be required to carry out emergency works in order to prevent injury to persons or damage to property and in such circumstances will not be required to provide a Quote prior to undertaking the works the subject of the Variation and the Customer shall be liable to pay the Seller the reasonable costs and expenses incurred with an emergency Variation.

At the Seller’s sole discretion a deposit may be required, the deposit amount or percentage of the Price will be stipulated at the time of the order of the Goods and shall become immediately due and payable prior to the commencement of any works. Subject to these terms and conditions any deposit paid by the customer upon acceptance of the Order by the Seller is non-refundable in the event of the work being cancelled by the Customer.

Time for payment of the Price is of the essence. If the Customer fails to pay the Price when due in, the Seller may:

  • Treat the Contract as repudiated by the Customer;
  • Suspend Delivery of the Goods or Services the subject of the Contract and any Goods or Services the subject of any other Contract with the Customer, without incurring any Liability to the Customer in respect of such treatment or suspension; and
  • Without prejudice to the rights of the Seller under the Contract, if the Customer fails to pay the Price when due, the Customer must pay interest to the Seller on the outstanding amount of the Price at the rate of 2.5% per month compounding monthly from the date due until the date of actual payment.

The Customer is not entitled to make any deduction from the Price (including, but not limited to) in respect of any set-off or counterclaim unless agreed in writing prior by the Seller.

The Customer must pay the Seller an amount equal to any reasonable expenses, costs or disbursements incurred by the Seller in recovering any outstanding monies owed by the Customer to the Seller (including, but not limited to, debt collection fees, Court costs and solicitors costs on an indemnity basis) or enforcing any default or breach of this Contract by the Customer.

If a detailed report is requested by the Customer for the Services carried out by the Seller in addition to the standard invoice and description of the work and Services, the Seller reserves the right to charge an appropriate hourly rate for compiling, preparing and submitting the report. The charge will be a minimum of one hour’s labour and will be estimated depending on the scope of the work required to prepare the report. If the Customer does not agree to pay the estimated cost of a detailed report, the Seller will be under no obligation to provide the report requested. The Seller also reserves the right to request payment in advance for the costs of preparing the detailed report.

  1. Delivery of Goods & Services

Delivery of Goods and Services shall be made to the Customer’s nominated address stipulated in the Order.

It is the customer’s responsibility to:

  • Obtain all consents (including Body Corporate if the property is part of a Strata Plan) and to make all arrangements to provide the Seller with access to the site where the Goods and Services are to be delivered and performed;
  • Provide the Seller with full details of any statutory restrictions or consents which may affect the Seller in delivering the Goods or performing the Services; and
  • Provide the Seller, its contractors and employees with safe and reasonable access to the site where the Services are to be performed or to where the Goods will be delivered including the removal of any furniture or personal items that may impede access (the Customer takes full responsibility for any loss or damage caused due to the Customer not taking reasonable action to minimise the risk of damage);
  • To allow the Seller’s employees and contractors to deliver the Goods and perform the Services during usual business hours.

Any time or date nominated or accepted by the Seller for performance, delivery, despatch, or arrival of the Goods or performance of the Services is an estimate only and does not constitute a term or condition of these Terms and Conditions or of the Contract.

The Seller is not liable for the consequences of any delay as a result of any cause outside the reasonable control of the Seller, notwithstanding that any such cause may be operative at the time of entering the Contract or accepting an Order. In these circumstances, the Seller may reasonably extend the time for performance, delivery, despatch or arrival of the Goods or performance of the Services, or cancel the Contract without incurring any Liability.

Time for performance, delivery, despatch or arrival of the Goods or performance of the Services is not of the essence of the Contract and the Customer may not cancel the Contract for any failure by the Seller to deliver the Goods or perform the Services by the estimated date.

Unless otherwise stated in writing, the Seller may make any partial deliveries of the Goods or performance of the Services, by instalments in any amounts the Seller may determine, and these Terms and Conditions apply to each partial delivery or instalment. Each part or instalment is taken to be sold under a separate Contract incorporating these Terms and Conditions.

The Seller may cancel the delivery of Goods or Services at any time before the Goods are delivered by notice in writing to the Customer. The Seller shall not be liable for any loss or damage whatever arising from such cancellation.

 

Privacy policy

Respecting your Privacy

Ease Electrical Group is committed to supporting the Australian Privacy Principles for all fair handling of Personal Information which set clear standards for the collection, use, disclosure, storage of and access to Personal Information collected during the course of business operations and compliance with the Privacy Act 1988 (Commonwealth) and its amendments (the Act), and the Australian Privacy Principles (APPs) set out in that Act.

Personal Information means your name, mailing or residential address, telephone number, email address and registration details including the company you work for, your role and financial information, including credit card information and information collected from credit reporting agencies.

Our respect for your rights to the privacy of your personal information is paramount.  We have policies and procedures in place to ensure that all personal information, no matter how or where it is obtained, is handled sensitively, securely and in accordance with the Australian Privacy Principles.

This Privacy Policy sets out:

  • What sort of personal information is collected and stored;
  • How information is collected and used;
  • What happens if you choose not to provide the required information; and
  • How you can request access to the personal information we hold about you.

Ease Electrical Group reserves the right to change our policy at any time. Amendments or replacements of the Privacy Policy will be available on our website.

Collection of Your Personal Information

We only collect personal information relevant to our business relationship with you so that we can provide our services and products. We may collect your personal information:

  1.              directly from you including via telephone, email or facsimile;
  2.              when your register on our website;
  3.               when you place an order or service request with us;

Where you submit personal information, we manage it by using up-to-date techniques and processes that meet current industry standards to ensure that your personal information is kept secure and confidential. You acknowledge and consent that by providing your personal information to us that we may use and disclose your personal information for the purpose for which it was collected or for a related or ancillary purpose such as:

  1. supply of our services and products to you in accordance with our Terms and Conditions and any agreement entered into with you, to facilitate, process, carry out and respond to your request;
  2. to our third party service providers to assist us in providing and improving our services and products to you and developing, improving and marketing our services and products to you;
  3. for regulatory reporting and compliance with our legal obligations, to various regulatory bodies and law enforcement officials and agencies to protect against fraud and for related security purposes;
